Can I Build a Granny Flat Without Consent in Auckland? (The 2026 70sqm Rule)

As of 15 January 2026, you can build a standalone granny flat up to 70 square metres in Auckland without a building consent under the Building and Construction (Small Stand-alone Dwellings) Amendment Act 2025. However, the build must still strictly meet the New Zealand Building Code in full, remain a single-storey structure, and be constructed or supervised by a Licensed Building Practitioner (LBP). Homeowners are also legally required to apply for a Project Information Memorandum (PIM) from Auckland Council before construction begins.
